By accessing boosthealthwell.com (the "Site") or purchasing any service from Boost Health Well ("Company," "we"), you agree to these Terms & Conditions, our Privacy Policy, and any care-plan agreement you sign. If you do not agree, please discontinue use of the Site and services.
2. Description of Services
We provide home health & wellness management including primary healthcare visits, cardiology monitoring, orthopedic rehabilitation, at-home laboratory testing, diagnostic coordination, telehealth consultations and preventive wellness programs, delivered by licensed clinicians within applicable state scopes of practice.
3. Medical Disclaimer
Content on this Site is for general informational purposes only and is not medical advice, diagnosis or treatment. Always seek the guidance of a qualified provider with any question regarding a medical condition. In an emergency, call 911 immediately — our services are not an emergency response system.
4. Eligibility & Accounts
You must be 18 or older to book services or create an account. Minors may receive care only under a parent/guardian account. You agree to provide accurate information, keep credentials confidential, and notify us of any unauthorized account use.
5. Bookings, Scheduling & Home Visits
- Booking requests submitted via our forms are confirmed by a care coordinator; a booking becomes effective only upon our written confirmation.
- You agree to provide safe, reasonable access to the residence and accurate health history relevant to care.
- We may reschedule visits for clinician safety, weather or clinical urgency, and will notify you promptly.
6. Fees, Payment & Insurance
Membership fees are billed monthly in advance at the published rate of your chosen plan. One-time services are quoted before delivery. We accept major cards and HSA/FSA where eligible. Where insurance applies, we verify benefits in good faith but final coverage determinations rest with your insurer; you remain responsible for balances not covered. Prices may change with 30 days' notice.
7. Cancellations & Refunds
- Memberships are month-to-month; cancel anytime effective at the end of the paid period.
- Individual visit cancellations require 24 hours' notice; late cancellations may incur a fee of up to 50% of the visit price.
- If we fail to deliver a confirmed service and cannot reschedule within 7 days, we refund that service in full.
8. Telehealth Terms
Telehealth visits use encrypted video platforms. You consent to electronic care delivery, acknowledge technology limitations, and understand that some conditions require in-person evaluation, which we will arrange or refer.
9. User Conduct & Site Use
You may not misuse the Site (including scraping, malware, unauthorized access, or submitting unlawful or infringing content through forms). Enquiry and newsletter submissions must contain accurate information belonging to you.
10. Intellectual Property
All Site content — text, design, logos, graphics and code — is owned by or licensed to Boost Health Well and protected by U.S. copyright and trademark law. You may not reproduce it commercially without written permission. Imagery is used under license from Pexels contributors.
11. Privacy & Health Data
Our handling of personal and health information is described in our Privacy Policy, incorporated into these Terms. Newsletter subscriptions are managed per CAN-SPAM, with unsubscribe processing via unsubscribe.php.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from Site use. Our total liability for any claim relating to the Site (excluding clinical malpractice, which is governed by applicable law and professional insurance) is limited to the fees paid in the three months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Boost Health Well, its clinicians and staff from claims arising from your misuse of the Site, provision of false information, or violation of these Terms.
14. Third-Party Services
Laboratories, imaging centers and payment processors act as independent contractors under their own agreements and regulatory obligations; we coordinate but do not control their internal operations.
15. Changes to Services & Terms
We may modify services, plans or these Terms to reflect clinical, legal or operational changes. Continued use after posting of updated Terms constitutes acceptance. Material changes to membership terms take effect at your next renewal with notice.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules. Disputes will first be addressed in good-faith negotiation; unresolved disputes fall under the exclusive jurisdiction of the state and federal courts located in Guernsey County, Ohio.
17. Severability & Entire Agreement
If any provision is held unenforceable, the remainder continues in force. These Terms, with the Privacy Policy and your signed care-plan agreement, constitute the entire agreement between you and Boost Health Well.
